The Supreme Court to Unblock the Completion of the Concession Tender in the Sea Port of Kherson

The Supreme Court of Ukraine has unblocked the completion of the concession tender in the sea port of Kherson, having revokedthe decision of the Sixth Administrative Court of Appeal of the Kyiv city.
On February 4, 2020, the Sixth Administrative Court of Appeal of the Kyiv city suspended the order of the Ministry of Infrastructure of Ukraine №16 of January 21, 2020 on approving the results of the concession tender and determining the concessionaire of the property complex of the sea port of Kherson. The lawsuit was filed by the “Special Company “Kherson Sea Port” LLC to demand the recognition as illegal and cancellation of the decision not to allow the company to participate in the concession tender.
Afterwards, the Ministry of Infrastructure stated that the decision was made without a proper assessment of the Ministry’s arguments. The Ministry disagreed with the above court decision and appealed the decision.
In mid-February, the Ministry had already achieved the suspension of the concession in the port of Kherson in court, but the decision was appealed.
